Box 490, Niwot, CO 80544 <br />REQUEST: A Site Specific Development Plan and an Amended Use by Special <br />Review Permit for a dewatered sand and gravel mine and materials <br />processing facility in the A (Agricultural) zone district. <br />LEGAL DESCRIPTION: Part S2 Section 8, part N2 Section 17, part NE4 Section <br />18, and part of SE4 Section 7, all in T2 N, R68W of the <br />6th P.M., Weld County, Colorado. <br />LOCATION: Approximately 1/2 mile north of Weld County Road 20 112 and <br />approximately 1 1/2 miles east of Weld County Road 1. <br />THE DIiPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE <br />APPROVED FOR THE FOLLOWING REASONS: <br />1. The submitted materials are in <br />requirements of Section 24.7, 44.1, <br />Zoning Ordinance. <br />compliance with the application <br />44.2, and 44.3 of the Weld County <br />2. It is the opinion of the Department of Planning Services' staff that the <br />applicant has shown compliance with Section 24.3 of the Weld County Zoning <br />Ordinance as follows: <br />- This proposal is consistent with the Weld County Comprehensive <br />Plan's Mineral Resources, Transportation and Urban Growth Boundary <br />Goals and Policies. The Conditions of Approval and Development <br />Standards will ensure that these goals and policies are met. The <br />Comprehensive Plan encourages the extraction of mineral resources <br />when the mining plan promotes reasonable and orderly development of <br />mineral resources. The City of Longmont has reviewed this case and <br />indicated a concern with the amount of time the access across their <br />property is proposed for. Condition of Approval I13 addresses this <br />concern. <br />- The proposal is consistent with the intent of the Agricultural zone <br />district and is provided for as a Use by Special Review. <br />- The uses permitted will be compatible with the existing surrounding <br />land uses and with the future development of the surrounding area as <br />permitted by the Weld County Comprehensive Plan. Surrounding land <br />uses include: Boulder Creek, pasture, rural residences, and <br />irrigated crops. <br />
