III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Eastside Mine conducted by Erica Crosby of DMG. No <br />company representative was present during the inspection. The Eastside Mine is in reclamation <br />only status. Weather conditions on site were clear and warm. Ground conditions were dry. <br />Records Mine records were inspected at the Garfield County Courthouse. See attached records <br />report for further detail. The following items need to be filed in the courthouse; <br />" The Certificate of Insurance expired 9/1/97. Anew insurance certificate needs to be <br />filed. <br />2nd and 3rd quarter pond inspection reports need to be filed in the courthouse. <br />Signs & Markers Mine ID and DMG location signs were posted, and all information appeared <br />accurate. Stream buffer signs were also visible. <br />Roads The road leading into the Eastside Mine was in dry. Road ditches and culverts were in <br />good repair. The gate at the mine entrance was locked to prevent access by the public. <br />Hydrologic Balance The sediment pond was dry and no recent discharge was noted. The <br />primary and emergency spillways were in good repair. The pond embankment was well <br />vegetated and stable. Vegetation in the permanent diversion ditch was well established, and no <br />erosion features were noted. This fall, the operator should install the rock down drain from the <br />toe of the permanent channel into the creek, as per the design. This will give the channel a <br />chance to stabilize before the upland diversion is removed. The clean water diversion ditch was <br />damp, but in good repair and well vegetated. <br />Backfilling & Grading The backfilled and graded areas appeared stable and there were no signs <br />of erosion. Vegetation is well established and diverse on site. The portal and fan areas appeared <br />stable and no subsidence features were noted. The mine water pipe was not discharging, and no <br />recent discharge was noted. <br />Revegetation Vegetation was well established and diverse throughout the mine site. The <br />northeast facing slope contained more perennial grasses than the southwest facing slope. The <br />entrance to the mine mainly consisted of yellow sweet clover. The dominant species noted on <br />site were intermediate wheatgrass, western wheat grass, yellow sweet clover, ricegrass, <br />cheatgrass, sage and schadscale. From recent discussions, the operator may initiate Phase II <br />Bond release some time this year. The Division should be contacted when vegetation monitoring <br />begins. <br />
