III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on November 8, 2000, by Harry Ranney of the Colorado DMG. <br />No problems were observed during the overflight. Due to field scheduling, the digital images <br />were not reviewed until November 20, 2000. The digital images were reviewed by Joe Dudash. <br />Facilities <br />The coal stockpile on the portal bench was large in volume but was not piled very close to the <br />portal bench edge. Coal was also being stockpiled on the southern end of the new lower coal <br />reclaim bench. No coal was observed going over the bench edge. There were no problems with <br />fugitive dust. <br />The operator continues to construct the downhill conveyor and [tuck loading system. <br />Roads <br />All of the roads were in good shape and appeazed to be passable. It appeared that the road to the <br />gob pile was damp, perhaps from a recent precipitation event. Scattered areas around the mine <br />site appeared to be damp as well. <br />Hvdroloev <br />The level of water in pond C did not appear to be over the primary discharge tube. The water in <br />the pond was blackish. Pond D appeared to be dry. There was a little water in pond B. <br />The collection ditch into pond B appeared to be functional. The silt fence down gradient of pond <br />B also appeared to be functional. <br />There did not appear to be any obvious problems with drainage ditches at the mine site. <br />Topsoil <br />There were no obvious erosional gullying at the topsoil stockpiles at the gob pile and the <br />coverflll stockpile. <br />
