III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Jim Burnell of DMG The weather was sunny, warm, <br />and humid. A heavy thunderstorm had hit the area the previous night, so conditions were quite <br />muddy. The site was quiet except for construction equipment passing by on the access road <br />along the West perimeter.. <br />Signs & Markers: Signs and markers were in place and up-to-date at the entrance and on topsoil <br />piles. <br />Roads: The roads were in excellent condition. The road along the west perimeter is now being <br />used as a short-cut by a construction firm. The road ditches aze in good shape with no evidence <br />of erosion. There are signs of minor erosion on the upslope side of the road between the ponds. <br />Hydro Balance: Pond A contained several inches of cleaz water near the dam. There is some <br />liner exposed in the spillway, but no sign of erosion. Tamarisk and several cottonwoods are <br />growing at the base of the in-face of the dam. <br />Pond B contains a maximum of 2 feet of muddy water, standing 18" below outlet pipe. The <br />emergency spillway is stable. At the major inlet channel on the East side of the pond, there is <br />what appeazs to be siltfence installed along the banks of the inlet to prevent sloughing and <br />erosion of the banks. The fabric has been "disarrayed;" it is loose and blowing around in the <br />wind. The channel itself is stable for its length, with no appazent erosion even in the heavy <br />rainfall of the night before. <br />The channel entering Pond B from the South still contains some standing water from the strong <br />flow of the night before. At the head of the draw, there is an abundance of brush and loose <br />material that washed in, but no soil erosion is evident. <br />All three culverts are open and free of debris. No water is present at the South end (stock pond.) <br />General Mine Compliance: The fence is tight and erect around the entire perimeter. <br />Fish & Wildlife: Saw several lizards and several cottontail rabbits in vicinity of Pond B. Doves <br />are very abundant, concentrated in and adjacent to the wooded area at the North end of the permit <br />area. <br />Topsoil: The water baz/rock&brush piles just outside the fence on the North side have served <br />well during the runoff events, stopping sediment transport. <br />
