_. <br />,: <br />~i <br />-2- <br />OBSERVATIONS <br />1. This inspection was done in response to an adjacent landowner's complaint <br />regarding an unpermitted dam and pond built upstream from the site, and the <br />potential impact this dam and pond could have on downstream water. <br />2. I observed a small dam and pond several hundred feet upstream from the <br />quarry area. A black plastic pipe leads from the dam outlet to the north end <br />of the permit area. However, the pipe was not connected to the discharge pipe <br />in the dam. Neither the water nor the pipe was observed being used, and the <br />quarry appears inactive at the present time. <br />3. Mr. Stack informed me that the pond may have been used for dust <br />suppression previously, but the present and proposed use of the water will be <br />for stock watering only. Water will not be used for any mining or <br />reclamation-related activities. The amount of water flowing into the pond is <br />roughly the same as the amount flowing out. <br />4. As long as the dam and water are not used as part of the mining or <br />reclamation activities, we have no jurisdiction over this pond or problem with <br />it. To ensure that the pond is not used for mining, the black pipe leading <br />from the pond to the quarry boundary should be removed, placed in the permit <br />area until disposal can be arranged, and finally properly disposed of. This <br />pipe should be removed from the drainage area and placed in the quarry area by <br />the end of this month. .Evidence of this action should be provided to our <br />Division shortly after along with plans for final pipe disposal. <br />5. The quarry generally is in compliance with the permit provisions. <br />Processed and unprocessed aggregate stockpiles are present. No equipment is <br />on site.
