III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This permit is in temporary cessation. <br />There was about two feet of snow over the site. <br />Sims and Markers <br />Signs were in place, and with one exception, in good repair. A permit boundary sign, midway along the <br />Seneca II Cross-Road, is in disrepair. <br />Roads <br />The roads were covered with snow. From the shape of the snow cover, they appeazed to be stable and <br />in place. <br />Hydrologic Balance <br />Sedimentation Ponds 1 and 2 were snow covered, as were the sites of the monitoring wells. There was <br />no appearance of damage or malfunction. There was no indication, through the snow cover, of <br />dischazge from the ponds. <br />Support Facilities <br />Structures, other than the sedimentation ponds and ditches, are in disrepair. The broken windows on <br />the load-out structure have been boazded up. <br />General Mine Plan Compliance <br />This permit is in temporary cessation. There was no indication on site that any of the permitted work to <br />coven the site from aload-out to a load-in facility had been accomplished. <br />Fish and Wildlife <br />There are no unique, other than performance requirements of other subjects of the Permit Application <br />Package (PAP), at the site. However, the standazd for raptor protection on power transmission facilities <br />cited in the PAP at Tab 21, Page 3, needs to be updated. The Division currently recognizes the <br />Suggested Practices for Avian Protection on Power Lines.• State of the Art in 2005 as the "best <br />technology currently available" [required by Rule 4.18(1)] for avian protection. <br />Revegetation <br />The permit is in temporary cessation.
