III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the New Horizon Mine for the month of iDecember, 1995. <br />Inspection of reclaimed Channel AA - BB revealed that the channel does not yet meet the <br />designed specifications that are in the approved permit. All design criteria seem to have been <br />met except the bottom width of the channel which is designed at 30 feet. This width varies <br />from point AA to point BB and is, in some places, as narrow as approximately 15 feet. Western <br />Fuels -Colorado will need to either perform maintenance on this ditch so that it meets the <br />approved reclaimed configuration, or recalculate the ditch hydrologic characteristics to verify <br />that the current design will safely pass the 10 / 24 precipitation event and submit a technical <br />revision,if necessary, to incorporate any revised designs into the permit. <br />Five topsoil depth test holes were dug in the area where the prime farmland topsoil was <br />reapplied. The results of this sampling are marginal at best due to frozen ground conditions and <br />lack of a definite boundary between the lower horizon of topsoil and the layer of prime farmland <br />material. It is recommended that this sampling be re-conducted next spring after the ground <br />thaws out. <br />Results -Test Hole #1 - 7.5" <br />Test Hole #2 - 4" <br />Test Hole #3 - 8" <br />Test Hole #4 - 13.5" <br />Test Hole #5 - 9.5" <br />
