A site inspection was made of Road Runners Rest II in preparation for pending enforcement action scheduled for the <br />September 18, 2002 Board Meeting. The last site inspection was conducted on March 9, 2001. The purpose of the <br />inspection was to note any significant changes at the site since March 9, 2001. Present during the inspection was Steve <br />O'Brian of Environment Inc. Mr. O'Brian represents the operator Suburban Sand 8c Gravel Co. <br />2. The Division noted in the March 9, 2001 report that the operator is conducting dry mining and de-watering operations <br />in the absence of necessary approvals from the Office of the State Engineer prior to exposure of groundwater. The <br />operator was given three {3) options far correcting this problem on or before June 5, 2001. These options included a) <br />provide written correspondence from the Office of the State Engineer which verifies compliance with all of their permitting <br />requirements for existing de-watering, dry mining, and water management practices at Road Runners Rest II, b) backfill <br />the pit excavation to an elevation that is at least four (4) feet within the original ground surface, or c) submit a properly <br />executed financial warranty in the amount of $29,765,600. None of these three options had been completed as of July <br />29, 2002. Therefore, a Reason to Believe letter was sent to the operator for insufficient bond and a formal public hearing <br />had been scheduled for the September 18, 2002 Board Meeting. <br />3. The following changes were noted since the last site inspection on March 9, 2001: 1) mining is nearly completed, 2) the <br />de-watering pumps have been removed and the pit has been allowed to start filling with groundwater, 3) the "finger' <br />separating the north and south lakes has been removed via mining and all previous equipment and stockpiles from the <br />"finger" are now gone, 4) approximately 65% of the entire 125 acre pit excavation contains exposed groundwater at an <br />average depth of 6 feet, 5) there is approximately 20 acre-feet of rough grading needed to smooth remaining overburden <br />piles within the pit floor, 6) all of the west shoreline has been re-graded to a 3:1 slope, 7) approximately 1875 linear feet <br />of south shoreline have been re-graded to a 3:1 slope, 8) approximately 2375 linear feet of south shoreline remain <br />disturbed at a 0.5/1 slope, and 9) approximately 1300 linear feet of east shoreline remain disturbed at a 0.5/1 slope. <br />(There has been no change in the north shoreline since March 9, 2001). <br />4. At the time of inspection, none of the corrective actions listed in Item 2 above were completed. These concerns will be <br />presented before the Board at the September 18, 2002 Meeting. <br />5. Due to the changes noted in Item 3 above, the Division has re-calculated the cost to backfill the entire pit excavation to <br />an elevation that is within Four (4) feet of the original ground surface.
