III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken durng the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gofiam of the Colorado Division of <br />Minerals and Geology. This site consists of two separate reclaimed areas; a coal <br />IoadouUtipple area and a portal area, separated by a rocky ridgeline Ground conditions on <br />this day were dry and the weather was hot. <br />Roads <br />The road up the canyon to the disturbed area was smooth with no rutting or damage. No <br />recent evidence of grazing was noted although there was a portion of a mineral block 20 <br />yards or so from the main gate. The gate was locked and access was by foot only. <br />Hydrologic Balance <br />The upper bench sediment pond was dry. Moderate flow was observed in South Oak Creek <br />that runs past the main gate but no flow was noted in the canyon where the mine is situated. <br />One pond is also located at the former coal sales yard along Coal Creek. The dominant shrub is rubber rabbitbrush. <br />Vegetation on the reclaimed area appears better and more vigorous than that in the <br />surrounding area. Noxious weeds were not observed. <br />
