<br /> <br />(Page :2) <br />MINE ID # OR PROSPECTING ID #: M-1999-n 18 <br />INSPECTION DATE: m/inn <br />OBSERVATIONS <br /> <br />INSPECTOR'S INITIALS: Ci u <br />The following observations were made during Buz inspection in response to a complaint <br />send to the Division. One of the neighbors e:cpressed concerns that barrels and tires <br />were being buried on the site, and asked th~~ Division to inspect the site, <br />1) Signs were posted as required by the Rule;. The boundaries have been marked with <br />fencing, road boundaries, and stakes. <br />2) The pit is within the permit boundaries, and operations were being conducted in <br />accordance with the mining plan. <br />3) 4 large 36^ tires had been placed in a square on the end of one of the excavation <br />terraces, but were not buried. Upon questioning the site employees and Mr. Wagner, <br />it was learned that these tires had been F~lace both to give the backhoe traction <br />on the crumbly shelf, and to ground the equipment from lightening strikes. No <br />recently excavated areas where refuse cou13 be buried were found on the site. The <br />long excavation trench had shale and grave]. waste near the base of the cut slopes, <br />but nothing deep enough to conceal trash. The various stockpiles around the site <br />appeared to have been there for some time (many were the same shape and size as <br />they were during the last inspection) and did not appear to be irregular enough <br />to be concealing waste piles. <br />4) Upon discussion of the barrels of oil which the Operator uses, the Division was <br />informed that Wagner Construction buys almost exclusively from Trevenen oil, and <br />returns the empty barrels to the company for recycling. A letter from Trevenen was <br />forwarded to DMG, in which a basic invent;ory of the last year's purchases and <br />returns was outlined. This does not conclLisively prove that no oil barrels were <br />buried at the site, but does seem to indicate that other operating arrangements <br />which are more economical are already in F~lace. (See attachment) <br />At this time, the Division is satisfied that r.o illegal refuse disposal has occurred <br />at the time. DMG will recalculate the bond within the next two weeks, to verify that <br />the currently posted financial warranty is sufficient to reclaim the disturbed <br />excavation trench and complete backfilling of the slope. <br />No other problems were noted at the site at this time. <br />I & E Contact Address <br />NAME: Jav Wagner _ <br />OPERATOR: Wanner Construction <br />STREET: 96400 E.
