This
inspection also served to evaluate current site conditions for use in recalculation of the reclamation cost estimate. The
reclamation cost estimate will be recalculated in the next few weeks and forwarded to the operator at that time.
Several stockpiles are located on site, including a stockpile of fines for use as growth medium during reclamation.
The mine identification sign is in place and in compliance. Permit boundary markers are in place at the pit corners.
However, it is recommended that additional markers be placed along the boundaries to ensure operations stay within the
boundaries.
The fence that serves as the north pit boundary has been removed from the outcrop mound. Excavation of material and
other mining related disturbance has taken place on approximately .75 acres outside the permit boundary, on the top of
the outcrop. An additional .5-1 acres outside the permit boundary has stockpiles of riprap placed on it. These piles are
located just west of the access road and just north of the north permit boundary. The operator indicated that this land
belongs to an irrigation water supply company and that the off-site disturbance was caused by the operator, for the
extraction and stockpiling of riprap material for the irrigation company, at their request. The operator will need to document
this agreement, indicating the intended use of the material that was excavated. Without this documentation, the Division
will proceed with an enforcement action for mining operations conducted outside approved permit boundaries.
There is also a very small disturbance, just outside the southeast corner of the site. It appears that an equipment operator
pushed an small pile of material just beyond the permit boundary. This situation reinforces the Division's position on
recommending additional boundary markers so the equipment operators can clearly identify the permit boundary. The
operator was instructed to carefully pull the small pile of material back inside the boundary.
No weed problems were noted on site during this inspection.
The Division's copy of the lease for the property that the operation is located on shows that the lease has expired. The
operator needs to submit a current lease for the property.
To reduce the timeframe that may be applicable to civil penalty calculations for an enforcement action (off-site
disturbancel, the operator is encouraged to conduct the corrective actions, shown on page 3 of this report, as soon as
possible.
Responses to this inspection report should be sent to:
Division of Minerals and Geology, 484 Turner Drive, Building F, Suite 101, Durango, Colorado 81301, Attn: Steve Shuey.
Phone no. 970-247-5062.
I & E Contact Address cc: Tom Gillis, DMG
^ CE
NAME Chris DeGolver ^ BL
OPERATOR Southway Construction Comoanv ^ FS
STREET 117 White Pine Drive ^ HW
CITY/STATE/ZIP Alamosa.
