III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DRMS. The operator was represented <br />by Henry Bazbe of Mountain Coal Company. Also along on the inspection were Chris Hansen of <br />ArchWestern and Scott Lewis of Arch Coal. <br />The operator's representative reported that longwall mining was active in pane120 and development <br />mining was occurring in panels 21 and 25. <br />The ground was covered with a foot of snow which limited access and ground observations during the <br />inspection. With the operator's consent, this report was issued from the Denver office of DRMS. <br />Roads <br />Road surfaces, embankments, and road ditches and culverts were in good repair in the main surface <br />facilities area and Sylvester Gulch. <br />Hvdroloaic Balance <br />Mine water was not dischazging from outfa11017 in Sylvester Gulch. Pond MB-2R was dischazging <br />less than 1 cfs of clear water. <br />Unlined ditches next to Sylvester Gulch Road and the concrete-lined ditches in the main surface <br />facilities area could not be inspected due to snow cover. <br />Processine Waste <br />The faces of the Refuse Pile Expansion pile and the Lower Refuse Pile showed no evidence of <br />structural instability. Survey markers were in place on the faces of both piles. The top of the Lower <br />Pile is being used for equipment storage, as approved. <br />Suaaort Facilities <br />No problems were found on the Materials Storage Bench, the trash compactor area, or the explosives <br />magazine. Vent shaft sites were in good shape in Sylvester Gulch. No problems were found at the jet <br />hole site. Construction of the parking lot expansion was underway. This expansion has been <br />previously approved. <br />Topsoil <br />The main topsoil stockpile (next to the coal stockpile area and FW-1 pond) appeared to be in good <br />shape and was well marked. <br />3 <br />
