(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~-iv79-r9~ <br />INSPECTION DATE: '~/9/OS INSPECTOR' S INITIALS: _KAP <br />OBSERVATIONS <br />This inspection was conducted as part of the 4-year monitoring program conducted by the Division of <br />Minerals and Geology. Present at the inspection were Kate Pickford and Harry Posey, DMG, and Dan <br />Moyer, Trans Colorado Concrete. Weather at the time of the inspection was clear, calm, and <br />approximately 60 degrees. <br />2. A sign is posted at the entrance to the site and the boundaries are marked. The site currently consists of <br />two distinct excavated areas, one located on the upland terrace -identified as areas B 1 and B2 on the <br />Mine Plan Map -and the second on the lower terrace where the access road enters the southwestern <br />portion of the site -identified as area P 1 on the Mine Plan Map. There are also stockpiles of material <br />and topsoil on the site. The stockpiled material consists primarily of rounded boulders. The topsoil <br />stockpiles are currently devoid of vegetation, and Mr. Moyer was advised as to the Rules and <br />Regulations regarding seeding of stockpiled topsoil (See problem 1, Page 3 of this report). <br />3. This site is permitted for 53.9 acres, with a maximum disturbance of 9.9 acres. It appears that the <br />operation is currently at its maximum allowance for disturbed acreage. The permit specifies a 150-foot <br />setback on the west side of the operation as a buffer for eight-mile creek, and a 200-foot buffer along <br />the north side of the site between the operation and Road 122. The Operator is abiding by these <br />setbacks. Mr. Moyer indicated that a few truckloads of material were removed from the site in 2004 to <br />keep the permit in compliance as an active site. The material was transported to the company's <br />Fountain site for processing. <br />4. The excavation on the upper terrace is within approximately 27 feet on the utility pole located south of <br />the highwall. The utility pole immediately north of this pole has excavation immediately adjacent to the <br />pole. The conversion application submitted by Pete Lien on October 12, 1999, states specifically; "The <br />applicant will coordinate with the utility company before moving closer than 50 feet to any pole to <br />ensure that utilities services are not disrupted." The Division has no indication that the current proximity <br />of the excavation, relative to the utility poles, has been coordinated with the utility company (See <br />problem 2, Page 3 of this report). <br />5. The highwall along the eastern edge of the lower terrace, adjacent to the road that accesses the <br />upper terrace area, has a section approximately 40 feet in length that possesses a negative slope (See <br />problem 3, Page 4 of this report). <br />b. The current bond amount of $45,475 appears to be adequate for reclamation of the site.
