(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2003-092 <br />INSPECTION DATE: 1/3/05 <br />INSPECTOR'S INITIALS GRM <br />This inspection was conducted as part of the normal program established by the Colorado Division of Minerals and <br />Geology for amendments to active permitted sites. Nick Gray, through his consultant, has submitted an amendment <br />to the Gray Pit #1 permit to add an additiona15.3 acres to the approved 18.45. The additional acreage will allow for <br />the removal of the entire ridge and resources, which when completed appears to simplify reclamation ofthe site to a <br />more useful post mine land use. Nick Gray and Paul Kessler accompanied the inspector on site for this inspection. <br />The mine identification sign and affected area boundary markers are in place and in compliance with Rule 3.1.12. <br />The inspector noted the Public Notice as required by rule was posted at the entrance to the permitted site. The notice <br />meets all the requirements of the rule. T-posts and natural features delineate the current site boundaries. When it <br />becomes feasible to do so, the operator will need to mark the northern edge of the amended area to ensure no off site <br />disturbance occurs. <br />The current site has several stockpiles of processed materials on the work pad. A portable crusher was being <br />shipped out at the time of the inspection. The inspector also observed a truck being loaded with pea gravel. Overall, <br />the site is clean and well maintained. <br />Storm water is funneled towards a central outlet to the south that empties into the protected wetlands. The inspector <br />did not note any sedimentation or erosion issues that are impacting the wetlands at this time. However, the inspector <br />strongly suggested to Mr. Kessler that silt fencing be installed at the point of discharge to prevent any impacts in the <br />future. Mr. Kessler noted the suggestion and stated that they would install the fencing when weather permits as the <br />ground is frozen at this time. The inspector is noting the silt fence issue as a point of concern. No enforcement or <br />problem is noted at this time, but that may be changed if the requested fence is not installed or damage to the <br />wetlands occurs. <br />Topsoil and overburden at the current time are minimal. The amended area appears to have an over abundance <br />which will augment reclamation of the site when completed. <br />The small fuel tank and lubricant containers appear to be in proper secondary containment at this time. <br />As noted above, the 5.3 additional acres will allow the total removal of the ridge currently being mined. Once <br />mining is completed, the post-mined land use will develop an agricultural field for Mr. Gray's use. Mr. Gray <br />inquired about the possibilities of building a reservoir. The inspector advised that it would be best to complete <br />reclamation as planned under the permit and release it prior to any land use change. A change would require another <br />amendment to change the post-mined land use. Additionally, the Division would have to wait for any and all water <br />rights issues, augmentation plans, etc to be approved prior to approval of any release request. <br />Due to the recent conversion review of this permit to a 1120, no other issues are noted at this time. <br />The bond will be updated as part of the final amendment approval process. <br />
