III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on Apri15, 2006 by Mike Boulay <br />of the DMG. Dennis Jones of Seneca Coal Company (SCC) was present during the inspection. <br />Weather conditions were cold and overcast, with storm clouds approaching. It began raining <br />towazds the end of the inspection. The mine site was partially snow covered, with some azeas of <br />heavy snow cover. Other than the use of the shop and truck wash facilities, there was no activity <br />at the mine site. <br />Roads <br />Road surfaces site wide were either snow packed or muddy. Access to the site was limited to the <br />two bone yard azeas, the shop/facilities area, and Sediment Ponds 002 and 003. The permanent <br />road accessing the Upper Wolf Creek azea was snow covered and inaccessible. All other mine <br />site roads were impassable due to snow packed or very muddy conditions. <br />Hvdroloeic Balance <br />Ponds 002 and 003 were the only sedimentation ponds accessible at the site. Ponds 002 and 003 <br />were both full and dischazging cleaz water. Significant runoff was occurring at the site. The <br />height of the runoff in the dischazge flume below Pond 002 was at 1.8 feet. It appeazed that <br />Grassy Creek had over flown its banks below the dischazge of Pond 003. Both ponds were <br />functioning as intended. <br />Support Facilities <br />The two bone yazds and the shop/facilities were clear of snow. These locations were muddy but <br />accessible. The shop and other facilities azeas were generally well maintained and no problems <br />were noted. <br />
