III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on September 28, 2004 by Mike <br />Boulay of the DMG. There were no representatives from Kerr Coal Company present during the <br />inspection and there was no activity at the mine site. Ground conditions were mostly damp <br />throughout the site. It was raining in azeas surrounding the site at the start of the inspection, and <br />began raining heavily with thunder and lightening in the northwest portion of the site towazds the <br />end of the inspection. <br />Roads <br />The permanent light use road was damp. The entire site was accessible. The surface of the road <br />was rutted due to traffic during wet conditions, since the time of the last inspection. <br />Hvdroloeic Balance <br />Sedimentation Ponds A, B, C, D, E, and F were inspected. Pond G was not inspected because it <br />began raining hazd and thunder and lightening was occurring in this location. Ponds A, B, and E <br />were retaining significant amounts of water but at levels well below the weep holes in the <br />primary spillways. Ponds C, D, and F were retaining very small amounts of murky water. None <br />of these site ponds were dischazging at the time of the inspection. <br />Support Facilities <br />The Surface Facilities Area was well kept. Perimeter azeas of the site were inspected and no <br />problems were noted. <br />
