M-86-11B INSPECTIDN DALE 1-31-95 INSPECTOR'S INITIALS SSS DBSERVATIDNS This was a routine inspection of the Neaselskin gravel operation which is cerritted to disturb 4.0 acres for the purpose of gravel extraction. The operation is cenitted to extract gravel to a depth of 30 feet fra an area that reasures approxirately 215 feet by 800 feet me operation is required to regrade the highwall to a 1:1 slope, the regaining area to 4:1 slopes and seed the site to cropland irediately followin the extraction praess. The disturbed area at the fire of inspection was estigated to reasure 800 feet by 400 feet or approxirately 7.3 acres. Additi ally, review of the latest ricrofilged annual report 11992) for the operation noted that the ocerator indicated his cerrit area was 10r acres and that a roxirately 5 acres had been backfilled. Based on this inforration, the Division has reason to believe that a violation of the ter-s and conditions of emit IFB6-148 exists. The highwall, in the estirated 200 feet by 200 feet lower pit area, appeared to be taller than the raziw 30 foot approved 'ning depth. Roy Brown, of Brawn Brothers Construction who is leasing the site fra the ocerator~cerrittee, indicated that the operator wishes to reclaig a pit to a pond, therefore they were in the process of giving deeper. If this is the case, the oceraWr should subgit, and receive Division approval f, a technical revision to cenit tf-B6-148 which addresses the changes in riving and reclaration plans that will result in the creation of a pond. Na r rights adequate to fill and raintain the pond will need to be docurented and County approval ray be necessary. If a revision for a post riving land use other than cropland is not approved, the operator will be required to fill the existing pit area back td an elevation consistent with the mrroundi fields so that irrigation can be cerforred as specified in the approved cenit. The operator should review the rewiregents of the Neaselskin pewit and be aware that any deviation fra those rewirerents rust be approved by the Division through the revision process before the uncergitted activity is in tiated. The fuel truck used to refuel ewiprent and crushers on site Est be stored in a designated area that provides adequate conkain~ent of the fuel in the event of a spill. In 1987, the U.S. congress mended the Clean Mater Act to expressly include store water discharges fra industrial sites a rewiring Clean dater Act controls. In 1990, EPA issued regulations that rewire specific industrial activities to obtain cerrits in order to disch ge store water fra their facilities. Active and inactive rinir~ operations where stop water cares into contact with overburden, raw raterial, inter iate products, byproduts, finished products or waste products located at the giving site are specifically included. The deadline to apply for a stow ter cergit was October 1, 1992. If a stow water pewit for this rive has not yet been obtained, the ocerator rust rake application for such a cerrit soon as possible. If any stow water control structures are rewired to be constructed at the rive as a result of the stow water cerritting pea a revision rust then be suhitted W this Division to include the operational and reclaration aspects of such structures in the Reclaration Pewit. Please be aware, Rule 3.1.12 of the Mineral Rules and Revelations rewires that: hI The operator shall post a sign at the entrance of the nine site which shall be clearly vi~ible fra the access road and specify the following: la) The nage of the ocerator, Ib) An indication that a reclarati~n pewit for the operation has been issued by the Colorado Ni ed Land Reclaration Board, and (c) The Penit Nugber. 12) The boundaries of the affected area will be narked by ronurents or other rankers that are c ar1Y visible and adewate to delineate such boundaries. the sign and rankers were not observed during the inspection and should be installed as indicated above.
