III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Tbis was a partial inspection conducted by Jce Dudash of the Colorado DMG. No one represented the operator <br />during the field inspection. <br />West Mine <br />The backfilling and grading at the West Mine is holding up very well. The vegetative cover is good and there <br />were no signs of erosional gullying or slope instability. The two sediment ponds were dry. Pond embankments <br />appeared to be stable although the vegetative wver on the embankments was poor. The silt fence along the <br />edges of the disturbed area and the straw bales in the north side light use road ditch were in pace and were <br />functional. The operator has added additional surface disturbance markers to better define the disturbed area. <br />The mine ID sign was up at the entrance to the West Mine partially reclaimed fan site, although the new mine <br />ID sign still needs to be put up. The silt fence was functional, although the fence had fallen offofa couple of <br />their posts. The topsoil stockpile was well vegetated. The topsoil stockpile sign was up and surface disturbance <br />markers were up azoand the site. The entrance road was in good condition. <br />Run-of--Mine (ROM} Pile <br />The graveled entrance road was in very good condition, The sediment pond at this location was dry. The pond <br />embanlonent was well grassed and stable. The gated primary discharge pipe valve was closed. Surface <br />disturbance markers were up. The mine ID sign was also up but the new mine ID sign still needs to be installed. <br />The top of the pile was dry. The topsoil pile was well vegetated, although the topsoil stockpile sign was off of its <br />post. <br />Unit Train Loadout <br />The Union Pacific Railroad equipment and supplies that had been temporarily stored at this site have been <br />removed. Mine equipment and concrete barriers were stored on site, however. There was no activity at the <br />loadout. The operator has installed new mine ID signs at each of the three entrances. The west entrance gate was <br />closed. Surface disturbance markers were up, although the markers on the extreme west side of the loadout need <br />to be moved westwazd to include the collection ditch. <br />There was a fav amount of water in the sediment pond. The gated valve was closed and the pond's bin wall <br />appeared to be stable. There also was water flowing in the Farmers Ditch culvert beneath the pond. <br />Hiehwav Coal Stoclmile <br />The sediment pond was dry at this partially reclaimed site. Straw bales were in place along the railroad tracks <br />and at the west side culvert inlet. The operator has installed a new mine ID sign at the entrance and the entrance <br />road was dry and in good condition. The cut slope appeared to be stable and had a good vegetative cover. The <br />surface disturbance markers were up around the site, although the markers on the east side should be moved <br />eastward to include the black bridge road overpass. <br />c:/word/bowiel/insp0805 <br />
