<br />IH. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete inspection of the Terror Creek Loadout was conducted by <br />Christine Johnston of the Division. It was lightly raining during <br />the inspection. <br />AVAILABILITY OF RECORDS <br />Records for the Terror Creek Loadout were reviewed at the mine <br />office. In addition to the Certificate of Deposit for $96,550.95, <br />a Letter of Credit is on file for $115,346.05. The pond inspection <br />for third quarter has been completed. TCC should forward this <br />report to the Division as soon as possible. For a complete list of <br />records reviewed and comments please the enclosed form, DMG <br />Availability of Records. <br />Terror Creek's application for a dilute antifreeze tank was <br />available for review at the Delta County Courthouse. It was <br />received on September, 28, 1994. <br />SIGNS AND MARKERS <br />The permit sign at the east entrance to the disturbed area has been <br />repaired as requested during a previous inspection. <br />HYDROLOGIC BALANCE <br />The ditch on the northwest side of the coal pad has been cleaned as <br />requested during a previous inspection. All ditches and culverts <br />have been well maintained. <br />059INS.106 <br />
