III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash and Jim Stark of the <br />Colorado DMG. No one represented the operator. The weather was clear and <br />dry, although it had rained lightly the day before. According to other mine <br />operators in the valley, the area has been getting some heavy rains the last few <br />weeks. <br />Signs and Markers <br />The mine ID sign was up at the road entrance to the mine site and contained the <br />correct information. Boundary markers were up between the ponds and the river <br />Roads <br />The entrance road was in good shape. The bridge was passable and the gate <br />was locked. <br />Hydrology <br />The water level in the sedimentation pond was half way up the gated valve. The <br />valve was closed and there was no discharge. The emergency spillway was <br />functional. The pond inslopes and outslopes were stable and grassed. <br />The operator has recently constructed a water treatment pond next to the <br />sedimentation pond. Seep water from the slump area to the south is collected <br />and piped underground to this pond. The treatment pond was discharging orange <br />colored water. The water level in the treatment pond was 8 inches below the <br />emergency tube. Because the treatment pond is new, there was no vegetation on <br />the embankment top, outslopes or inslopes.
