., <br />• (Page 2) <br />MINE ID f OR PROSPECTING ID f M-83-132 <br />INSPECTION DATE 02/28/95 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection by the Division was performed as a follow up to monitor compliance with <br />corrective actions required as a result of a previous inspection (dated 11/30/93). The <br />operator was contacted about the inspection but was not able to be present for it. There was <br />a little snow and ice on the ground, but that did not prevent the necessary items from being <br />inspected. <br />The Bite has an adequate sign and visible corner markers present. <br />The operator has supplied correspondence from the Water Quality Control Division showing that <br />no stormwater management plan is necessary for this site. That issue was regarded as a <br />problem from the previous inspection. The aforementioned letter from WQCD has now abated <br />that problem. <br />The oil and fuel storage tanks, noted in the previous inspection report ae a problem, have <br />been removed from the permit area. The many piles of limbs and wood debris have also been <br />removed. All those items appear to be stored immediately east of the permit area, on the <br />operator's land. The operator had sent the Division a letter (dated 3(28/94) stating that <br />all this had been removed, and requesting additional time for the complete removal of the <br />extensive concrete and asphalt on the pit floor. Additional time is granted, but the <br />operator ie reminded that any progress toward their removal should be communicated to the <br />Division in a timely fashion. The Division recognizes that these materials are a "resource" <br />in this area, and that the land ie owned by the permittee. But the Division reminds the <br />operator that, within this defined permit area, storage of these materials et ill constitutes <br />a use not in compliance with the approved mining plan and permit, and they are materials <br />whose removal would have to be bonded for. This ie regarded as a use not in compliance <br />because the neither the approved mining plan nor the post-mining land use was for the <br />temporary or permanent storage of these types of materials. The bond must cover their <br />removal because the reclamation toward the approved poet-mining land use is agriculture. If <br />the operator wishes to provide evidence of local government approval that the site may remain <br />ae a storage or disposal site, the materials in question might be in compliance and their <br />removal not required. <br />At this time there ie an existing $5000.00 bond. Preliminary calculations show that this <br />amount would be adequate to reclaim the site, except for the coat of removing the asphalt and <br />concrete, mentioned above. The reclamation bond will be re-evaluated soon, including the <br />removal and proper disposal of the asphalt and concrete. The revised figures, when complete, <br />will be sent to the operator for review. If the operator wishes to influence the reclamation <br />costa, timely removal and reporting of that activity will be important. <br />The site appears stable overall. The pit floor ie flat and sandy. The highwall ie <br />approximately 200 ft long and averages 10 ft high. Mining ie progressing to the east, into <br />a "sand dune." The limits of the sand dune and the eastern permit boundary are only about <br />50 or 60 ft farther to the east. <br />There is no native topsoil anywhere in this sand dune area.
