• (Page 21 • <br />MINE ID # OR PROSPECTING ID # M-85-023 <br />INSPECTION DATE 12/2/99 INSP CTOR'S INITIALS RCO <br />OBSERVATIONS <br />This partial inspection was performed by the Division as part of its monitoring of Construction M erials 110 permits. The <br />operator was contacted about the inspection and a time was arranged to meet at the site. The~perator, named on page <br />one, arrived onsite at 13:45 and was present throughout the remainder of the inspection. <br />The operator has been the permittee of this site since January 1999. There were numerous existi g clean up tasks to carry <br />out at that time, the previous operator having created them and left them. The present operator has been systematically <br />cleaning up the site of its contaminated soils, drums of hydrocarbons, waste asphalt material, di apidated equipment and <br />debris. This inspection was to measure the progress of such clean up so that a more represe tative reclamation bond <br />amount may be estimated. <br />There is currently a total of 515,000 posted as bond for this site. This figure was felt to be inade uate to perform all final <br />reclamation, and a bond recalculation was performed and sent to the operator earlier this year. wring the inspection the <br />operator hand delivered to this inspector a written summary of reclamation that has been perfor ed. Onsite verification <br />shows that these tasks should now be deleted from the total estimated bond amount. The current ist of reclamation taskss <br />will be revised to reflect the ones still outstanding, which should be the ones to base the bond a punt on. (Please note, <br />that tasks remaining on the list, which are to be performed for final reclamation, have no timeframe attached to them. They <br />simply need to be bonded until completed, whether completion is in 2000 or at the end of minin many years from now.l <br />The operator asked about converting this permit to a 112 permit. A conversion is possible, but perhaps not until January <br />2001. According to Rule 1.11.2(1) the operator is to have held the permit for two years befdre a conversion can be <br />granted. Some clarification may be warranted here, however, since this is not a new permit. If {his rule is intended only <br />for operators of newly-issued permits, then a conversion may be performed soon. This inspecto~ will request an opinion <br />from the Denver office and contact the operator. <br />The operator also requested a copy of the Construction Materials Rule and Regulations, which t is inspector was able to <br />deliver onsite. An invoice for the 55.00 cost of the document is attached to the operator's cop of this report. <br />permit ID Sian bears the name of the current operator.
