III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division <br />of Minerals and Geology. This former underground mine was reclaimed and reseeded <br />in 1996 and early 1997. The mine has achieved a Phase II bond release for the <br />majority of the disturbed area. The ground was dry with snow cover in shaded <br />areas. The weather was cool but mild for January. <br />Availability of Records <br />The public copy of the mine records is maintained by Ron Thompson of Peak Project <br />Management on behalf of Basin Resources. The records are kept at the Tri-State <br />railyard office located on the west side of Trinidad south of Highway 12. All <br />records were found in compliance and as detailed on the attached checklist. <br />Signs and Markers <br />Disturbed area markers were checked for all reclaimed areas. Disturbed area <br />markers are placed along the boundary of all reclaimed areas with undisturbed <br />areas. The markers are 4 inch white PUC pipe over a roof bolt anchored in the <br />ground. One marker was found knocked down near the top of the slope leading to <br />the water tank reclamation. All other markers were found in good condition. <br />Hydrologic Balance <br />The distinct sound of running water was heard in the mine vent shaft near pond 2. <br />Although this site is bond released as a gas extraction site, the mine continues <br />to monitor water flooding the mine for level and quality. The source of this <br />water and possibly its quality should be determined. <br />Revegetation <br />The rangeland and irrigated pastureland reference areas are required to be fenced. <br />Fencing was checked at both of these sites. Both of the west fence corners of the <br />rangeland reference area require repair. The pastureland reference area fence was <br />in excellent condition. <br />Overall, the site appeared in normal condition for the winter season. No problems <br />were found. <br />3 <br />
