On the last page of that report one item <br />was noted as a "problem." We wish to provide the following information in response to that <br />item. This letter is to be considered as the requisite "corrective" action that the report <br />indicates should be achieved by August 7, 1992. <br />The "probletn" listed has to do with the water-quality information for the area downgradient <br />of the Lower Tailings facility, whether it is currently on file with the MLRD. For <br />information purposes, we are enclosing a spreadsheet that contains all of the chemical and <br />physical data that were required to be collected over the period of the NPDF.S permit <br />condition. <br />We need to clarify that the permit condition requiring ground-water quality monitoring <br />dnwngrariient of the Lower Tailing Impoundment was a condition of the NPDES <br />(Department of Health) pennit. A]I reporting was to the Water Quality Control Division. <br />]t was ~, to our knowledge, a condition of the MLRD/MLRB reclamation permit. The <br />requirement was removed from the NPDES perntit when that permit was renewed a few <br />years ago. The WQCD agreed that there were no longer any impacts that were attributable <br />to the tailings impoundment in its current state. The collection and reporting was <br />terminated when the permit condition was removed. <br />I hope that the Division agrees that the monitoring was properly completed based on the <br />data that have been generated. <br />Should any questions arise, please call me as soon as possible. <br />Sincerely, <br />John E.
