III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of CDMG. The Grassy Gap mine is a reclaimed surface <br />mine. The mine permit and reclamation liability bond have been revoked by DMG. <br />Signs & Markers : DMG informational signs remains at intersection between Pit 2/3 road and Pit 5/6 road and <br />along the Pit 4 road. Main entrance gate at Routt County Road No. 27 was locked. DMG has been provided <br />with the combination. Cattle were present near [he Yoast Mine sediment pond. Sheep were present near Pond 5. <br />Two aggressive sheep dogs were running loose with the sheep. Shepherd was camped in the pit 6 area. <br />Inspector did not leave the vehicle in the Pit 5/Pit 6 are or on the road to Pits 2 & 3, and road to Pit 1 due to the <br />loose dogs. The gate was locked upon leaving the site <br />Roads : The access road to Pit 5 and 6 remains in good condition. The access road to Pits 2/3 has developed <br />gullies from runoff and spring water flow. The majority of water from the native springs on access road 2/3 <br />continues to be directed off the roadway. Pit 4 access road remains in good condition the entire way to the pit. <br />Some water cutting across the road has occurred but road is still drivable. <br />Hydroloeic Balance: Pit 5 spoil spring flow is low. Pond 5 was discharging. Pond 5 side slopes and <br />embankment appear stable. Sheep were concentrated near Pond 5. No additional slumping of the pond cut <br />slope, or of the pond inlet was apparent. Pond 4 was holding a small pool of water several feet below the outlet <br />elevation. No problems observed with Pond 4. <br />Reve elation: Vegetation is dry and has been grazed throughout the mine site. Pit 4 west facing slope <br />immediately above Pond 4 had been heavily grazed. Thistles were present but had been grazed as well. No <br />erosional features were apparent in spite of this heavy usage. Pit 4 above this slope was in very good condition. <br />It looked as if the livestock had not ventured beyond the immediate vicinity of the pond. The lightly grazed areas <br />of Pit 4 are in good condition with good vegetative cover, few weedy species, and no erosional rills or gullies <br />present. Pit I cover looked healthy from a distance. Access to Pit 1 was hampered by sheep dogs running loose. <br />Pit 1 did not look as if livestock had grazed pit. Pit 5 and 6 looked heavily grazed, very dry and very sparse. <br />Curly cup gumweed was present in the heavily grazed areas, around ponds 4 & 5, along access roads, the west <br />facing slope near Pond 4, Pit 5 spoil spring area, and Pit 6. <br />Slides: No new slides were noted. The old slide to the west of pond 4 is healing and is almost hidden by <br />vegetation. <br />Wildlife: A Golden Eagle at pit 4 was observed, as well as a doe Mule deer. Livestock, shepherd and dogs were <br />located in the southern extent of the mine. <br />
