<br />III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On June 20, 1991 a partial inspection was conducted at the <br />Orchard Valley Mine. Present during the inspection was Karl <br />Koehler. The weather was clear and it did not appear that it had <br />rained in the past week. <br />A tour was taken of the entire mine surface facilities area. <br />Ditches appeared to be in good condition. At the crusher building <br />bench, the temporary reject storage pile had been pulled back <br />from the edge of the bench embankment. <br />The refuse area was inspected. This mine may in the future sell <br />the refuse in the pile as coal product to the Nucla powerplant. <br />The Division will be notified prior to this. <br />The West portal area was inspected. Ditches and culverts where in <br />good working order. 'Phe operator was advised that the oil booms <br />should be replaced on a regular basis to make sure that their <br />effectiveness is maintained. Other oil control measures are being <br />used at this area such as hay bails. This mine has never had a <br />discharge at this pond that exceeded NPDES standards. <br />The topsoil pile where an NOV was issued last month was <br />inspected. This NOV was abated the day that it was issued. Seed <br />was noted on the pile but none of it appeared to have germinated. <br />
