III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division) on February 22, 2007. This mine is in <br />permanent cessation and reclamation of most areas is complete. Ground conditions were <br />generally dry and the weather was mild and breezy. <br />Hydrologic Balance <br />Ponds 4 and 5 were both dry. although it appeared that both held small amounts of water in <br />the recent past. Primary users appeared normal and funcUOnal. Cleanout of the inlet to the <br />road culvert above pond 5 was noted as was some maintenance work on the rock check <br />dams above the pond inlet channel east of the mine access road. The Magpie creek <br />diversion channel showed no sign of damage due to runoff from snow melt.
