<br />III. Comments - Compliance <br /> <br />Below are particular issues with regard to any of the above compliance items. Enforcement <br />actions resulting from Failure to comply with the Act, Rules and Regulations, and the permit <br />also are identified below. <br />1. The operator could not locate the required records during our inspection. Subsequent <br />conversations with Larry Reschke and Plarve Adams indicated that they are on file. The <br />operator should have all records on file and readily available in a conspicuous location <br />so that they will be available no matter who is at the mine as a contact person. The <br />following documents will be checked next inspection: <br />Permit <br />Permit Application <br />Current P1onitoring Reports - hydrology <br />NPDES Permits <br />Emissions Permits <br />2. The permit number on the mine I.D. sign will need to be changed after permit issuance. <br />3. Work was almost complete on the modifications to the drainage and sediment control system. <br />P•1inor regrading needs to bb done on the portal bench to ensure positive drainage. <br />The small surge pond was constructed to control runoff from the storage area at the access <br />road switchback. <br />4. The refuse stockpile area was inspected. Refuse was contained within the approved area. <br />A ditch and large boulders were used to mark the bounkary of the storage yard so as to <br />restrict the area of the pile and protect adjacent topsoil. <br />5. The strawbale filters are no longer being used at the mine entrance. All water is now <br />routed to a pond. <br />6. All culverts were removed from the topsoil stockpile area. <br />
