III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. Jim Kiger represented the <br />operator during the field inspection and records check. <br />Roads <br />The paved main haul road was in very good condition. The guard rail was in place. The east side graveled <br />entrance road was in good condition. The east side entrance gate was open. The light use road by the railroad <br />tracks was in good condition as well. <br />Facilities <br />There was a small amount of coal stockpiled on the facilities bench. Coal haul trucks were unloading and <br />railcars were being loaded during the inspection. The road to the coal haul truck unloading azea had been <br />watered. In spite of high winds, there was no fugitive dust that was going offsite. There also was no sign of coal <br />dust being tracked onto the highway. <br />There were no problems at the mine office, shop, substation, material storage area and loading facilities. There <br />were no fuel leaks at the fuel facility. <br />Hydrology <br />The sediment control system was functioning properly. Culverts were clear and ditches had sufficient capacity. <br />The straw bales and silt fence were in place along the railroad track small area exemption. <br />There was only a small pool of water in the east side sediment pond. The primary discharge pipe valve was <br />closed. The pond inslopes were well vegetated. The pond embankment was also well vegetated and appeared to <br />be stable. The west side dugout pond was dry. <br />Signs and Mazkers <br />The mine ID signs were up at the main entrance, east entrance and on the side road near the railroad tracks. The <br />required information was on each sign. Permit boundary markers were up around the site. <br />Toasoil Stockpiles <br />The west side topsoil stockpile was well vegetated. The collection and diversion berm around the stockpile was <br />in place. The topsoil sign was up on the pile. The east topsoil stockpile had a moderate vegetative cover. The <br />collection ditch and the diversion ditch were functional. The topsoil stockpile signs were up. <br />Records <br />As the following records checklist shows, the mine records were in compliance <br />c:/word/tercor/insp0407 <br /> <br />
