<br />III. COMMENTS - COMPt.IANCE <br />Below are comments on the inspection. The comments include discussion of obsevations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action, <br />This was a complete inspection conducted by Joe Dudash Uf the Colorado Division of Minerals and <br />Geology. Mazk Milner represented the operator during the field inspection and the records check. The <br />loadout azea was wet due to a recent precipitation event. <br />Roads <br />The main paved haul road was in good shape and clear of any dirt or coal. The light use road was in <br />good shape. The gate was closed. <br />Siens and Markers <br />Mine ID signs were present at the appropriate locations and contained the correct information. Perrnit <br />boundary mazkers were also up. . <br />. Hydrology <br />The water level in pond 1 was 2 feet below dischazge. The gated primary was closed. The emergency <br />spillway was well gra, sed, as was the pond embankment. Pond ?was dry. The spillways were <br />functional. <br />The culverts and ditches azound the loadout were functional. The straw bales and silt fence were in <br />place and functional at the railroad track SAE. <br />ropsoil -. <br />There were no signs of erosional problems at the topsoil stockpiles. The east topsoil stockpiles had <br />~~ moderate.to good vegetation. The west topsoil stockpile was well grassed. Topsoil stocltpile diversion <br />and collection ditches were functional. Topsoil signs were up. <br />:i <br />Facilities <br />The coal stockpile is away from the facilities bench outslope. The fuel azea berm was functional. There <br />were no problems observed with any of the other facilities as well. <br />Records <br />All of the records were in compliance.
