(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1 eR9-024 <br />INSPECTION DATE: S-~n-02 INSPECTOR'S INITIALS: _JfL <br />OBSERVATIONS <br />Completed a partial inspection of this site to determine whether the operator initiated mining activities since the last <br />inspection. <br />Currently, the Division is preparing to take the operator to the Mined Land Reclamation Board for failure to maintain a <br />financial warranty in good standing because the bonding company went into liquidation last year. It is important that an <br />operator maintain an adequate financial warranty throughout the life of the mine. The bond money would be used to <br />reclaim the site if the permit was revoked and the bond forfeited. This would ensure that the site would be adequately <br />reclaimed. <br />In this case, the operator has not yet initiated mining activities so, for now, there is no reclamation requirement. However, <br />in order for a permit to issue, the applicant must submit, and maintain, an adequate financial warranty. <br />Since the Reason to Believe has already been sent to the operator, this will not be noted as a problem in this report. The <br />operator should be aware that a possible violation may exist and, if the Board finds a violation at the June 26-27, 2002 <br />hearing, the Board could assess a civil penalty in the amount of $100.00 - $1,000.00 per day for each day of violation. <br />The operator has a variety of options; request a release of reclamation responsibility (which would terminate the permit) or <br />submit another acceptable financial warranty in the amount of $5,000.00 prior to the Monday preceeding the Board <br />hearing Qune 24, 2002). <br />If you have any questions regarding bonding, please contact Suzi Ericksen at 303-866-4920.
