III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a combined Surety Release and Joint Random Sample inspection of the Carbon <br />Junction Mine for the month of March, 1997. <br />Availability of Records: All records were inspected and found to be satisfactory, although there <br />were some difference of opinions between the federal and state interpretations on certain <br />aspects of length of time to maintain records and when quarterly PE inspections on waste piles <br />can be terminated. See page 5 of this report for further details. <br />Hvdrolo~ic Balance: All ditches and ponds were inspected and found to be in compliance, both <br />ponds were stable and vegetated. Pond one requires some minor maintenance where the water <br />enters the pond from each topsoil pile. Pond 2 had some water in it but was not discharging. <br />All culverts were clear and capable of functioning as designed. Two sections of the lower <br />section of the East Collection Channel below each set of triple culverts require side slope <br />maintenance and riprap protection as they show signs of embankment erosion. <br />Excess Spoil and Development Waste : Spoil material is no longer being deposited on the fill <br />area and the site is ready for pond construction to commence. It was discussed that in order to <br />facilitate the golf course construction that the excess spoil pile be eliminated by using that <br />material to construct the permanent Carbon Junction diversion and pond, thereby eliminating the <br />necessity of having a permanent spoil pile. This scenario could be used if mining operations <br />cease to be viable at this particular location. <br />Engineering work on the redesign of the 100 year diversion is under review by the Division and <br />preliminary indications suggest that every thing is in order and the review should be completed <br />by 8 April 97. <br />The gravel company is still operating but there is very little activity at this time of year. <br />Construction of the golf course adjacent to the permit area has temporarily been halted because <br />of the weather, however, construction will commence again when the ground conditions are <br />favorable. <br />Bond Release Inspection : The old explosive's pad and road leading up to it were inspected for <br />the Phase I, II, and III liability release. It was determined that since the area was minimally <br />disturbed and entirely covered in gravel, the probability of sediment being carried offsite was <br />extremely small and would be equal or less than adjacent undisturbed areas. The request for <br />release of liability is therefore approved and construction of the golf course on this released area <br />may commence. <br />
