III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions.taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on Apri121, 2004 by Mike <br />Boulay of the DMG. There was no representative from Kerr Coal Company present during the <br />inspection. Weather conditions were cold and overcast. A significant storm passed through the <br />azea just prior to my arrival at the site. The site was covered in a few inches of heavy wet snow <br />and slush. <br />Roads <br />The permanent light use road that accesses the site was muddy and partially snow covered. <br />Access to the site was limited to perimeter azeas and Ponds E, F, and G due to the saturated <br />ground and slick road conditions. The surface facilities azea was viewed from a distance and <br />there was no appazent activity at the mine site during the inspection. Perimeter azeas of the site <br />appeazed to be well maintained and no problems were noted. <br />Hvdroloeic Balance <br />Site sedimentation ponds E, F, and G were viewed. Road ditches and culverts were snow <br />covered in the vicinity of Ponds F and G. Pond E was full to a level approximately one foot <br />below the principal spillway. Pond F was retaining some water at a level well below the <br />principal spillway. The surface of Ponds E and F were not frozen. Pond G was snow covered <br />but was not retaining water. Pond inlets and embankments were mostly snow covered at all pond <br />locations and none of the ponds were dischazging at the time of the inspection. <br />
