Long <br />Division Director <br />RE: Buena Vista Pit (Permit h1-77-1961 Stam, of compliance problems identified in the report of [hc <br />Division's 2/3/99 inspection of the pit. <br />Deaz Mr. Baznhart: <br />As a result of your letter dated March 9, 1999, the Division has altered the status of certain of the above <br />referenced compliance problems as follows: <br />Compliance Problem t (Information required as result of inactivity): This problem has been <br />vacated as a result of your report of activity in 1997 and 1998. <br />Compliance Problem 2 (Adequate marking of permit area boundaries): This problem has not been <br />resolved since you did no[ report the required marking as being completed. <br />Compliance Problem 3 (Topsoil stabilization): This problem has been vacated based on your <br />assurance that the topsoil will be utilized this year. <br />Compliance Problem 4 (Topsoil adequacy): This problem is unresolved at this time since the <br />permit amendment altering the post minin; land use and reclamation needs has rotbeer. submitted. <br />Compliance Problem 5 (Mining disturbance outside permit area): This problem has been abated <br />based on your commitment to reclaim the area. <br />Compliance Problem 6 (Possible damage to utility line): This problem is unresolved at this time <br />since neither a compensation agreement with the owner has been provided nor an engineering evaluation <br />supplied that demonstrates the line will not be damaged by the mining operation. <br />Compliance Problem 7 (InsufTicient financial warranty): This problem is unresolved at this time <br />since an agreement has not been reached on the amount of warranty required and that amount posted with = <br />the Division. <br />If you have any questions on the above, please contact me. <br />Sincerely, <br />James C.
