NOTICE OF PROPOSED DECISION
STATE OF COLORADO,

In accordance with Rule 5.02.2(8) of the
Regulations of the Colorado Mined Land
ReGamaUon Board for Coal Mining, Ne Col-
oratlo Division of Minerals and Geology pro-
poses to approve a Reduction in Inspection
frequency (RIF) for the Ohio Creek No. 2
Mine (Permit Number C-80-002). The Divi-
sion isproposing tc reduce the inspection fre-
quency to two wmplete inspections per year,
once in the spring and once in the fail. This
RIF is based on a complete inspection of the
site performed on 4 May 2004 and findings
that the mine site has been stabilized and re-
claimed and at this time threat to the Dubllc
or the environment has been minimized to
the extent possible. '
The Ohio Creek No. 2 Mine is an under-
ground coal mine located in Gunnison Coun-
tyapproximately 16 miles North W Gunnison,
Colorado. The mine was operated by Robert
Weaver. The permit and reclamation bond for
Ne Ohio Creek No. 2 Mine were revoked and
forteited, respectively, by the Mined Land
Reclamation eoartl on 21 Fehruary 1996.
The enact legal description of the mine is SI/2
of lots I and 2, which said lots are coexten-
sive with the SE 1/4 of the NE1/4 and the
SW 1/4 of the NE 1/4 of Section 16, Township
15 South, Range 86 West, 61h P.M. This area
is 60 acres in size. The permit area can be
found on the USGS Mount Axtell 7.5 minute
Quadrengle.

of Mineral and Geology. Centennial Building,

an interest who may be adversely aHecled liy
the proposed decision may provide written
comments on the proposed decision. Such
requests must be submitted to the Division,
fo the attention of Jim Stark, within 30 days
of the initial publication of this notice, must be
in writing antl must state with reasonable
specificity the reason(s) for the request and
the objection(s) to the proposetl decision.
