III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On November 18 and 19, 1996 William J. Carter from the Division of Miner- <br />als and Geology performed a complete inspection at Hawk's Nest Mine. On <br />Monday most of the ground was covered by snow and therefore additional <br />inspections were completed on Tuesday and Thursday. <br />Roads: <br />The old State highway is in a reasonable condition considering the amount of <br />traffic it carries. There are several potholes that have developed due to water <br />moving off the slope above the east portal and not able to reach the culvert <br />due to some sliding action. These barrow ditches should be pulled at several <br />locations by CDOT. <br />Hydrolo>;ic Balance: <br />• The pond west of the substation of the west portal area, south of the old <br />State highway had very little water in it, and appears in very good condi- <br />tion. <br />• The seeps found on both the east and west side of the east portal are ac- <br />tively flowing. It is the seep from the west side of the portal along with <br />normal snow melt that is running across the highway because of the <br />CDOT barrow ditch being obstructed. <br />• Some rills are present south of the highway below the east portal, these are <br />not new and will need to be checked in the spring during and after snow <br />melt. <br />• The two bales of straw that were placed to control the erosion of the gullies <br />located below the highway of the east portal appear to continue to func- <br />tion. <br />Fish and Wildlife: <br />Several deer were observed browsing the site during the inspections, and <br />tracks indicate a great deal of use of the area by both deer and elk. <br />ReveRetation• <br />Many of the areas indicate a great deal of new germination at this time. <br />Evaluation of the establishment of these new plants will be evaluated next <br />spring and summer. <br />
