III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Jim Kiger represented <br />the operator. The area in general has received a lot of rain and some snow last week. The loadout area <br />had some snow cover but mainly was very wet. <br />Facilities <br />The inspection took place after the loadout had closed for the day. There were no coal haul trucks <br />unloading and no rail cazs were being loaded. There was a moderate amount of stockpiled coal on site. <br />The fines stockpile was small. This is because Oxbow is screening out a lot of the fines from their coal <br />that they send to the Terror Creek Loadout. There were no signs of fugitive dust offsite. ' <br />No problems were noted with the fuel facilities, substation or the office/warehouse area. There were <br />not many loaded rail cars on site during the inspection. <br />l~drolosv <br />The operator has done some recent ditch maintenance at the loadout. Ditches had sufficient capacity <br />and loadout culverts were clear. The straw bales and silt fence for the railroad sae's were functional. <br />However, two straw bales on the east side need some repositioning. Also, maintenance work is needed <br />on one silt fence section. <br />There was ice-covered water in the east pond, the level of which was within one foot of the primary <br />gated valve. The primary discharge valve was in the closed position. The pond embankment was <br />stable, as were the pond inslopes. The west pond had no standing water in it, although there was <br />evidence that some water had been in it, probably from snowmelt. The pond spillway was functional <br />and the silt fence in the spillway notch was in place. A small slump occurred in the hill slope adjacent <br />to the west pond. The operator will regrade the immediate area of the hill slope. <br />Topsoil Stockpile <br />There were no problems observed at the two topsoil stockpiles. Topsoil signs were up. <br />Roads <br />The paved main haul road was in good condition. There was some dirt that had been tracked on to the <br />main highway but it was not a problem. There is a side drain along the road that needs to have some <br />repair work done since the area is starting to show some erosion. <br />c:/word/terror/insp0105 <br /> <br />
