III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection was conducted by Joe Dudash of the Colorado DRMS. No one represented the operator <br />during the inspection. <br />Hvdroloev <br />Pond 4 was completely dry. The pond spillways were in place and were functional. The pond 4 embankment had <br />a very good vegetative cover and was stable. Pond inslopes were stable as well. The road culvert that brings <br />disturbed area runoff from the reclaimed coal stockpile area to pond 4 was clear. The upland diversion ditch at <br />the reclaimed coal stockpile area was well vegetated and had enough capacity. <br />Pond 5 also was dry. The spillways were operational and the pond inslopes were stable. The collection ditch <br />leading into the north side of pond 5 was well vegetated and had the required capacity. <br />Only the north underdrain had any water coming out of it and it was only small drips of water. The black culvert <br />that brings water from the upper bench down to the pond 5 collection ditch was in place. <br />Roads <br />The Hubbard Creek road was dry and in good condition. The access road across Hubbard Creek and which goes <br />to pond 5 was also in good condition. The front gate was locked. <br />Siens and Markers <br />The mine ID sign was on the front gate and the required information was on the sign. The "records location" <br />sign was also on the gate. Surface disturbance markers were up around the site. <br />Reclamation <br />The reclaimed mine site was well vegetated. The backfilled slopes appeared to be stable. There were no signs of <br />slumping or cracking. Erosionally, the backfilled slopes were stable as well. <br />The reclaimed haul road was in good shape. There were no signs of slope instability. <br />There was a small infestation of what appeazs to be Russian Knapweed in an area immediately north and <br />adjacent to pond 4.
