III. COMMENTS • COMPLIANCE <br />Below are comments on fhe inspection. The comments include discussion of observations made during fhe inspection. Comments <br />also describe any enforcement ocfions taken during the inspection and fhe facts of evidence suppoding fhe enforcement action. <br />Colowyo Coal Company, L.P. (Colowyo) representative Tay Tonozzi (Tonozzi) accompanied Byron G. Walker <br />(Walker} during this inspection. An inspection in-briefing and debriefing was conducted with Tonozzi and Crellin <br />Scott of Colowyo. The inspection was conducted on 14 and 15 February 2005. This report was prepazed in, and <br />issued from, the Division of Minerals and Geology (Division) offices in Denver. Pictures included in the report aze <br />on electronic file at the Division, and will be provided to Colowyo upon request. <br />AVAILABILITY OF RECORDS <br />See the attached records inventory sheet. All required documents were found on file. <br />ROADS <br />Unpaved roads about the permit aze~a were muddy but in good shape. Haul road culverts M and K had been cleaned, <br />but both had silted back in to the point where cleaning is due again. Frequent maintenance will likely be required <br />during spring runoff. The main haul road was being sanded. The scoria collection ditch at the road crossing needs to <br />be reshaped. The best management practice sediment traps along the Taylor Creek Road were functioning well and in <br />good repair. <br />HYDROLOGIC BALANCE <br />Approximately a foot of snow covered the site upon arrival, and approximately another foot of snow fell during the <br />inspection period. There had been some snowmelt. The work azea pond was receiving surface flows from all three <br />entries. There was a clear water dischazge of 0.02 cubic feet per second (cfs) [9 gallons per minute (gpm)] from the <br />Work Area pond (CDPS point 002A). There was a clear water dischazge from the Streeter Pond (CDPS point OOIA) <br />of 0.03 cfs (13.5 gpm). There was a clear water dischazge From the Gossard Loadout pond (CDPS point 003A) of <br />0.01 cfs (4.5 gpm). There was a trickle of cleaz water dischazge from the Stoker Loadout pond (CDPS point OOSA). <br />The water level was estimated at 8 feet below the lowest discharge point at the West Pit pond. The water level was <br />estimated at 1.5 feet below the lowest dischazge point at the East Taylor pond. Water upland of, and within, the West <br />Pit is being managed in the pit itself. Water is likewise being managed in the East Pit. The water level was estimated <br />at 3 feet below the lowest discharge point at the Prospect pond. The water level was estimated at 3 feet below the <br />lowest discharge point at the Gulch A pond. The water level was estimated at 4 feet below the lowest dischazge point <br />at the Gossard Rail Loop pond. <br />BACKFILL & GRADING <br />Backfill was being worked by dragline at the extreme northeast comer of East Pit reclamation. Material was <br />being brought up-slope so as to blend in with undisturbed terrain at the toe of slopes. No shovel-truck backfill <br />operations were observed during the inspection. No final grading was noticed. <br />EXPLOSIVES <br />Blast records were in compliance with the rules. The blast records of three detonations were checked in detail, <br />and were found to be complete.
