Should the top soil stockpile need <br />to be iroved frnm its present location to scxne other stockpile area prior <br />to topsoil reclamation we will comply with the Division's rules that require <br />approval prior to relocation. <br />Item #2, (Mining within 200 feet of a structure.) We have contacted Tri-State <br />Generation and Transmission Association Inc. of Denver (Thornton), the <br />owners of the powers line that crosses the affected area. They have agreed to <br />grant us a "license" to mine within a distance of serething less than 200 feet <br />of the pole structures. They will state the distance in their "license". They <br />have inspected the sight and r,e are atiaiting their reply. When it is received <br />we Trill send you a copy for your records. <br />Item 3. (Limited Activity) This mine does operate more than 180 days per <br />year. Generally tha.re is activity at the mine from April 1st thru <br />November 30th (8 months) each year. These activities include mining, loading <br />from stockpiles and other related mining activity. Aye have diswvered that on <br />our last tuo Annual Reports re have erro>Deously marked "YES" to the question, <br />"Has the mine been granted Tenporary Cessation Status,". The reports should <br />have been marked "NO". Please correct your reports for the past t~.o years. <br />Therefore, since the mine is active for 180 days or more per year we do not need <br />or wish to apply for a Tenporary Cessation Status. <br />I hope :this is an adequate response to your hens.
