• (Page 21 • <br />MINE ID # OR PROSPECTING ID # M-1988-021 <br />INSPECTION DATE 10/19/01 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection was performed by the Division as Part of its monitoring of Construction Materials 110 permits. The operator <br />was contacted about the inspection, but was not present far it. The site was not active at the time of the inspection. <br />There was no permit ID sign observed at the entrance to the site, though one is required pursuant to Rule 3.1.12. There <br />was a wooden post near the east edge of the site, possibly to be used for such a sign. The NE and SE boundary corner <br />markers were observed, but the NW and SW markers were not present. The lack of ID sign and two of the markers is <br />noted as a problem in this report. Please see the last page of the report for the corrective action and correction date. Rule <br />3.1.12, copied from the Construction Materials Rules and Regulations, is enclosed with the operator's copy of this report, <br />to explain what information must appear on the permit ID sign. <br />The site has changed little since the photo submitted with the 2000 annual report was taken. The main area of extraction <br />is still in the NE corner, which exhibits a 15-foot vertical highwall. The NW corner has been stripped, presumably in <br />anticipation of mining or stockpiling there. The SE corner contains the deep soil which is aloowed to be removed, since <br />there is a surplus above the amount needed to complete the approved reclamation. The west edge of the site is a level <br />pit floor, daylighting to the bottomland on the west. Some stockpiled product exists on the south part of the floor. <br />Equipment onsite consists of a loader and an old D7 cable dozer. There is very little debris, other than a couple old loader <br />tires. (Note: if livestock have pushed down T-posts which previously marked the permit corners, placement of the old tires <br />alone or with re-installed T-posts inside them could be tried as new markers. Tires around posts often keep livestock from <br />pushing them down.l <br />The fuel and fluids are stored on the west edge of the pit floor. There is a 500- to 600-gallon diesel tank up on a stand, <br />and numerous small buckets and jugs of other fluids stored below it. The diesel tank may be relatively empty, but still holds <br />enough that its faulty hose handle allows fuel to drip on the ground. Signs of prior spillage from fueling are also evident, <br />with about 100 sq ft of stained soil adjacent to the tank. There is no secondary containment for these fluids at this <br />location. Due to the small size of the storage area and the small size of the past spillage/leakage, this is not yet considered <br />a problem. However, this is being brought to operator's attention so that remedial measures may be taken before further <br />contamination oc~:urs. Two things should be undertaken soon: 11 remove all hydrocarbon-contaminated soil from this <br />location, and either dispose of offsite it in a proper facility, or spread it in a thin layer on the access road and pit floor, <br />where it can be turned and will volatize; and 21 provide secondary spill containment for all fluids stored here, such as a <br />plastic-lined earthen berm around and under the tank, or simply park the tank stand and all other vessels inside a steel stock <br />tank. Completion of this should be performed soon, and fully reported in the next annual report. If a worsened condition <br />is found during the Division's next inspection, it may become a problem to be formally corrected. <br />The bond is currently 55,760. This is the amount calculated in 1996, and is due for recalculation soon. If an increase in <br />the bond is indicated, the new figures will be sent to the operator for review, at which time the operator will have 60 days <br />to provide the needed increase. <br />There were no additional items observed. Subsequent phone conversation with the operator revealed that there may be <br />interest in amending this 110 permit to add more acreage up to a total of 9.9 acres, or converting the permit to a 112 <br />permit for a total of 10 acres or more. New application materials were mailed to the operator under separate cover.
