III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the Blue Flame Coal Mine was conducted by DMG staff from the <br />Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. <br />The permit was revoked; financial warranty was forfeited and utilized for reclamation. No <br />activities were observed; no individuals were contacted during this inspection. <br />Evidence of two recent surface disturbances were observed. <br />A minor surface disturbance was evident at the location of a backfilled portal where settling had <br />resulted in a small opening. The small opening had been closed. The recent work had no <br />significant effect to the established vegetative cover. <br />The second disturbance appeared to have resulted from construction of a drainage ditch located <br />nearby the second portal. Large rock lined portions of the ditch. Equipment tracks and nature of <br />the disturbance suggests a hydraulic excavator was utilized. Evidence of broadcast seeding was <br />abundant through out the recent disturbance. <br />Five photos, taken during the inspection, accompany this report. <br />
