III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Carbon Junction Mine for the month of September, 2003. <br />Availability of Records: The records were satisfactory, see page 5 of this report for details. <br />Hydrologic Balance: All ditches, culverts and ponds were inspected. Both ponds had water m them but <br />appeared stable, and were not discharging. All culverts were clear and capable of functioning as <br />designed. A sigrrficant rainstorm occurred on September 9"~ and created numerous erosional problems <br />that require immediate attention. These were down the access road to the north pit (Picture #t), rock <br />check dams leading down to pond 2 (#2), on a hill down below the Oakridge egwpment storage area (#3) <br />Backfilling and Grading: All reclamation work has ceased due to problems between Four Comers and <br />Oakridge Energy that has apparently resulted in a Cease and Desist order for the gravel operations. The <br />reclamation work stoppage is highly unsatisfactory with the Division and must soon be resolved Smce the <br />work has slopped, it was noted that water has been allowed to pond on the excess overburden waste pile <br />(#4) ,which is a safety issue, and is m direct conflict with the coal reclamation regulations. THEREFORE, <br />Oakridge is given to the end of October 2003 to resume reclamation activities and immediately <br />restore the waste pile to an approved configuration. If this matter Is not resolved by the end of <br />October, Notices of Violations will be written. <br />General Mine Compliance: The saes' permuting actions have been m a turmoil since the above <br />menimned Oakridge. Four Corners problems have changed agreed upon boundanes and numerous other <br />conditions.
