<br />BN. G6 <br />76'3 641 <br />derived from operations under the terms of this Lease, and each <br />party shall pay its own income taxes. Lessee shall be obligated <br />to pay the taxes based upon production or operations hereunder <br />for the last year or portion of a year in which this Lease is in <br />effect, notwithstanding te*m~*+ation of this Lease prior to the <br />actual levying or payment of those taxes. Lessee shall furnish <br />Lessor with a copy of all paid tax receipts. <br />14. Lessee will keep Lessor reasonably informed of <br />Lessee's operations with respect to the Leased Premises. IIpon to <br />days' prior notice from Lessor to Lessee, coal quality data and <br />general reserve data relating to the Leased Premises will be made <br />available for joint review by Lessor and Lessee at either of the <br />following locations, as requested by Lessor: (a) the West Elk <br />Mine offices, or {b) Lessee's offices in Denver, Colorado. <br />Lessee shall provide Lessor with copies of any such data <br />requested by Lessor. Lessor will keep all such data confidential <br />during the term of this Lease. IIpon te~~nation of this Lease, <br />Lessee will deliver to Lessor copies of all data requested by <br />Lessor which is in the possession of Lessee and which relates to <br />the Leased Premises, and Lessor's confidentiality obligations <br />will terminate. <br />15_ Any notice, request or other information required <br />or permitted to be given or made under this Lease shall be in <br />writing and shall be deemed to have been properly given or <br />delivered to a party when delivered personally to any officer or <br />director of that party, or when sent by IInited States mail with <br />proper postage or charges prepaid and properly addressed to the <br />party for whom intended.
