III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />Not in an over-site capacity, Carl Johnston and Roslyn Higgin of the Office of Surface Mining <br />accompanied Byron Walker of the Division of Reclamation, Mining and Safety on this inspection. <br />SIGNS AND MARKERS <br />All of the permit identification signs need to be revised to read Chevron Mining Inc. in lieu of The <br />Pittsburg & Midway Coal Mining Co. Other than the company designations, signs and mazkers off <br />State Highway 131 and Routt County Road (RCR) 179 were in place and in good repair. The permit <br />number on the permit identification sign off of RCR 44Z is not legible. The permanent cessation <br />portion of the signs is in excellent condition. <br />ROADS <br />Roads were in good repair. As reported in previous inspections, the main access road to the Oak Creek <br />facilities area (an azea that has attained Phase III bond release) has been interdicted by a repaired <br />railroad crossing. Barrier poles are still in place and a road closed sign has been placed. <br />The gate on the North Haul Road is difficult to open. <br />HYDROLOGIC BALANCE <br />Some of the lower check dams of the Center-West Ridge Drainage Structure held water, as did all of <br />the sedimentation ponds. There was a trickle discharge from the middle French drain inlet of the West <br />Ridge Pond, but no discharge from the pond. There was no discharge from the north or south French <br />drains, or from the surface pvc piping. There was an estimated 1 cup/minute (0.05 gallon minute) <br />discharge from the Center Ridge Pond. The combined flow from the West Ridge and Center Ridge <br />Ponds and spoil springs through the flume at the CDPS outfa11007 of the CDPS permit 000032638 <br />was 0.07 cubic feet/second (a 0.04 flume reading). There was no discharge from the Moffat Area Pond. <br />SUPPORT FACILITIES <br />A permanent office building, associated facilities, and parking area remains on site. These facilities <br />have not attained any phase of bond release. There was no sign of change in condition. <br />Drainage ways were in good repair. The check dam spillways of the chain of pearls drainage feature <br />were in good shape. <br />All sediment pond embankments and discharge structures were in good repair.
