III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. Sandra White of BTU-Empire/RAG- <br />Empire Corp. accompanied the inspection and provided access to the records. The mine is in Temporary <br />Cessation. No active mining activity is occurring on the mine site. Mine site is dry and temperatures were mild, <br />approximately low 60's, high 50's. Afternoon winds picked up. <br />Records: Records were checked at the mine office. Records list accompanies this report. <br />Roads: Roads are in good condition through out mine site. Access road to 9-P2 and 9-P3 ponds has been <br />regraded to eliminate badger holes. Haul Road A in the N %z Section 32 remains unreclaimed. This haul road is <br />in the permit yet seldom used. <br />Hydroloeic Balance: Snow pack has mostly melted off. Ditches through out site are in <br />good condition, flowing water well, and no breaches were observed. Mine dewatering pumps were both off. <br />Leak repair in ponds 5-P5, P6, and P7 has been completed. The operator graded the inslope of the 5-P7 pond <br />and filled rodent burrows that were in the embankment. Pumps had not been turned back on yet so water level <br />remains below the level of the repair work. Piping between ponds is slated for repair work as well. North angle <br />is not currently pumping. Low water level in 9-P2 and 9-P3 ponds indicate that no pumping to the ponds has <br />
