III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Hayden Gulch Loadout conducted by Byron G. Walker (Walker) <br />of the Colorado Division of Minerals and Geology (Division). Jim Stark, the former Division <br />Environmental Protection Specialist for this permit, was also present. The inspection started at 13:30 <br />hours on 25 July 2005 with a records check at the offices of John Weinman (Weinman), and was <br />completed in the field that afternoon. Weinman was present during the records check, but did not <br />accompany the inspector to the field. This is a loadout facility only and it is currently in temporary <br />cessation. The weather was warm and sunny and the ground was dry. <br />Availability of Records All of the necessary records were available at the office of Hydro- <br />Environmental Solutions, Inc. in Steamboat Springs. See the Records Checklist at the end of this report <br />for more detailed information. <br />Signs and Markers Mine identification signs were in place as necessary as were mine permit boundary <br />signs at the loadout, the area along US 40, and the small area across the Seneca Haul Road (south of <br />the loadout itself). <br />Roads The truck loop (haul road), the road around the lower coal stockpile and the loadout access road <br />to the office building appeazed to be stable and in good condition. The access road to the site is the <br />Seneca TAHR. This road was stable and in good condition. <br />Hvdrologic Balance The truck loop pond (pond 001) contained water. The pond did not appear to have <br />discharged since the last inspection. The pond embankment was well vegetated, appeazed to be stable , <br />and no erosional problems observed. The outlet structures were in good repair. <br />The rail loop pond (pond 002) was wet at the bottom at the time of the inspection. The pond <br />embankment was well vegetated, appeazed to be stable, and no erosional problems were observed. <br />All of the ditches were well vegetated and in overall good condition. No erosional problems were <br />noted in any of the ditches. <br />Support Facilities The facilities area appeared to be stable and in good condition. No erosional <br />problems were observed on the site at the time of the inspection. Structures appeared to be in a minor <br />state of disrepair. The Rail Spur along US-40 appeared to be stable; however, the railroad ties appear to <br />be in disrepair. <br />C-1992-O81, 25 July 2005, page 3 of 5 pages <br />
