III. COMMENTS -COMPLIANCE <br />Below are comments on the rnspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the rnspection <br />and the facts or evidence supporting the enforcement action <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This former underground mine is reclaimed. Remaining buildings and <br />structures are approved to remain as permanent structures Ground conditions were dry in <br />exposed areas and the weather was cool and windy, Mr. Albert luppa, was present prior to <br />beginning the inspection. George Patterson of EFCI and a local contractor were on-site <br />performing maintenance work on the riprap section refuse ditch #1 <br />Roads <br />The mine access road was found in good condition. Surfacing material added within the last <br />year is holding up well The repair of the access road ditch east of the mine entrance gate is <br />also showing no sign of damage or down-cutting. <br />Hydrologic Balance <br />Due to a break in the weather and dry <br />surface conditions. the operator was <br />on-site conducting repairs to the south <br />side of the riprap section of refuse <br />ditch #1 Side cutting of the ditch had <br />resulted in some erasion along the <br />south side. The operator was re- <br />positioning material and re-shaping the <br />inner portions of the ditch and <br />repairing the area adjacent to the <br />ditch. Stockpiled rock was also <br />observed being placed along the <br />inside portions of this ditch, <br />Contour ditches seem to be holding up <br />well and no breaching of the outslopes of <br />these ditches was noted. The lone <br />sediment pond at the site was holding <br />water in the south half of the pond and <br />was not discharging. <br />Revectetation <br />Cattle were not observed on the site. The <br />area appears lightly grazed from approved <br />grazing activities by the landowner <br />
