III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on October 5, 2005 by Mike Boulay of <br />the DMG. Dennis Jones of Seneca Coal Company was present during the entire inspection. <br />Weather conditions were cloudy and cold with snow at higher elevations of the mine site. <br />Significant rainfall had occurred at the mine site within the previous 48 hours. Ground <br />conditions throughout the mine site were wet and muddy. <br />Roads <br />Access to the mine site was limited due to muddy road conditions. Road surfaces were saturated <br />and muddy. Haul Road A was accessible. Haul Road B was not accessible beyond the turnoff <br />for former Haul Road D. A grader was working on Haul Road B to improve the surface of the <br />road. The county access road along Sage Creek was accessible to Ponds 012, 013, and 014. <br />Hydrolosic Balance <br />Sedimentation Ponds 012, 013, and 014 were inspected. Ponds 012 and 013 were dischazging <br />cleaz water. Dennis Jones changed out hydrographs from each dischazge flume and collected <br />monthly samples for laboratory analysis from Pond 013. We also collected a sample for <br />settleable solids from Pond 013. Utilizing an Imhoff Cone aone-liter sample of pond dischazge <br />was analyzed for settleable solids. The sample result showed 0 ml/I of settleable solids. Pond <br />014 was retaining a significant amount of water but was not discharging. <br />Slides and Damaee <br />SCC informed the DMG of additional slope failure that occurred in mid-September at the site of <br />the slide-damaged area above Pond 012. The slide was inspected and appeazed to be stable at the <br />time of the inspection. No significant additional movement has occurred below the former haul <br />road embankment since the recent slope failure that occurred in mid-September. <br />SCC is proceeding with mitigation measures including constructing an under drain where a seep <br />has occurred and was previously noted in DMG inspection reports. SCC also plans to cut out the <br />slide and move material to the east of the pond. The under drain had been constructed and <br />backfilled at the base of the slide neaz the pond inlet at the time of this inspection. A trackhoe <br />was working in the pond inlet area to reconfigure the inlet to the pond. Please continue to keep <br />the DMG informed of progress in mitigating the slide and stabilizing the slide-damaged area. ' <br />
