Box 165 <br />Canon City, CO 81215 <br />Re: Changes to and Explanation of Monitoring Inspection Report dated December 22, 2000, North River <br />Pit, File No. M-1999-005. <br />Dear Ms. Bellantoni: <br />Thank you for your letter of January l2, 2001. I regret that you felt that my report regarding my December 22, <br />2000 inspection of the North River Pit was unduly harsh. Your recollection of my statements during the <br />inspection may be basically correct. I did indicate to you [hat there was one major problem and [hat the others <br />were more minor in nature. To be honest, I don't recall whether I told you which of the five issues I discussed <br />with you would be considered problems in my report and would require being resolved by Technical Revision <br />of the permit. I do recall discussing each of the issues with you and obtaining an explanation of each one. ~I also <br />recall discussing with you how you could handle each issue. <br />Below I have addressed each of your disagreements with the problems I listed in my report. <br />Problem No. l - A temporary groundwater dewatering system no[ included in the permit, has been installed <br />which includes discharge to the Arkansas River. <br />Your disagreement with this problem is that I referred to the removal of ground water as "dewatering" and that I <br />implied the use of dry mining techniques. I did no[ mean to imply that. I only mean[ to indicate that you were <br />removing ground water in preparation for initiating your wet mining operation and that the water you were <br />removing was being discharged to the Arkansas River. You object to using the term "dewatering" in a <br />Technical Revision. <br />You told me that a discharge permit had been obtained. I told you that, since the ground water removal by a <br />system of three high capacity pumps, a settling pond and discharge of water to the river was not included in the <br />permit that it should be by a Technical Revision. You do not have to refer to the removal of the water as <br />dewatering. Use your own choice of words to describe water removal from the ground. <br />A letter to you from Dan Holmer of the Water Quality Control Division informed you that, prior to removing <br />ground water in the manner that you are, a CDPS general permit for construction dewatering should be obtained. <br />Please provide with your Technical Revision evidence for our File that the permit was obtained. <br /> <br />Problem No. 2 -The staging/processing/s[ockpile area has been located on built up land in the Phase I area as <br />opposed to the permitted Phase N area. <br />
